I agree to the T&Cs

I, the individual (“Participant”), in consideration of my participation in the activities sponsored, provided by, or affiliated with Bungee Fitness (“Company”), including, but not limited to classes, workshops, lessons, personal training, individual direction, parties and all other uses of Company’s facilities, fixtures and equipment, whether or not taking place at or upon Company’s premises (“Activities”), hereby acknowledge and agree to the following terms of this Waiver of Liability, Medical Release and Authorization (“Waiver”).

Participant acknowledges that participation in the Activities may include exercises which are physically demanding and may subject the Participant to stress, anxiety, hazardous situations. Participant understands and agrees that the Activities involve an inherent risk of severe personal injury. Participant agrees that he/she, on behalf of Participant and Participant’s heirs, executors, administrators, or other personal representatives who may have standing to assert a claim on behalf of Participant, hereby expressly, voluntarily and without condition waives, releases, and forever discharges Company and Company’s owners, managers, officers, instructors, employees, representatives and agents (“Releasees”), from any and all liability for personal injury, death, damage to property or loss of any kind resulting from or arising out of Participant’s participation in the Activities, regardless of the cause of such injury, loss or damage; provided, that such cause is not the result of or does not arise from the intentional misconduct of Company or Releasees. Further, Participant assumes full and complete liability and responsibility and shall reimburse Company for any damage or injury to others or to Company’s facilities caused by Participant.

Participant represents that he/she is in satisfactory physical condition to participate in the Activities and understands that participation in the Activities is a voluntary decision made by Participant with knowledge of the risks attendant thereto. In lieu of providing a medical release from a doctor authorizing the participation of Participant in the Activities, Participant hereby represents that he/she has no knowledge of any physical or mental impairments, diseases, or other medical issues which could affect Participant’s safe participation in the Activities.

Participant agrees that the Company and its owners, managers, employees, instructors, representatives and agents are authorized to act for Participant according to their best judgment in any emergency requiring medical attention, including administration of first aid procedures, and Participant hereby waives and releases such persons from any and all liability for injuries, illnesses, or losses caused by or arising from said actions. Participant further authorizes medical transportation, at Participant’s sole expense, to a medical facility or hospital for treatment.

I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, The following entities or persons: Bungee Fitness and or JESSICA EMILY  Yarnold

I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.

Bungee Fitness Club

On my behalf, and/or behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Studio, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto.

I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Studio, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Studio class.

Acknowledgement of Risk Waiver THIS IS A CONTRACT — PLEASE READ THOROUGHLY BEFORE ACCEPTING THE TERMS In consideration of being permitted by Bungee Fitness Club Ltd to participate in an Activity and to use its studio, now and in the future, I hereby agree to release, indemnify and forever discharge Bungee Fitness Ltd, its agents, owners, members, shareholders, Directors, partners, employees, volunteers, manufacturers, participants, lessors, affiliates, its subsidiaries, related and affiliated entities, successors and assigns (the “RELEASED PARTIES”), on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

1. I acknowledge that my participation in an Activity and use of the Bungee Fitness Ltd entail known and unknown risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property or to third parties. I understand that such risks simply cannot be eliminated without jeopardising the essential qualities of the Activity. The risks include, among other things and without limitation: Bungees exposes a Participant to common risks of cuts and bruises amongst other more serious risks.

2. I expressly agree and promise to accept and assume all of the risks existing in an Activity. My participation in an Activity is purely voluntary, and I elect to participate despite the risks. I agree that I will undertake any Activity in accordance with the written safety rules and advice that I have received within the safety briefing and with any oral instructions or advice given to me prior to or during the session by a Court Monitor. I certify that to the best of my knowledge I do not have a medical condition which might have the effect of making it more likely that I will be involved in an incident which could result in injury to myself or others and that I am not pregnant. 

3. From time to time, we may photograph or video customers using the facilities at Bungee Fitness Ltd. If any photography or videoing is to take place then we will inform those attending to use our facilities at that given time. We do this as we use some photographs and videos on occasion for marketing purposes. This may be on our website, in promotional literature, flyers, emails, social media, press advertising and in adverts. We consider that showing people enjoying the use of our facilities is in the legitimate interests of our business but if a customer does not want to be photographed or filmed then they have the option of informing a member of staff when they attend to BFC. 

4. Should Bungee Fitness Ltd or anyone acting on their behalf, be required to incur legal fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. This means that I will pay all of those legal fees and costs myself. 

5. If the Participant is a minor, I agree that this release of liability and Acknowledgement of Risk Waiver (“RELEASE”) is made on behalf of that minor Participant and that all of the releases, waivers and promises herein are binding on that minor Participant. I represent that I have full authority as parent or guardian of the minor Participant to bind the minor Participant to this Agreement. 

6. In consideration of not being required to sign a fresh copy of this Waiver before each visit, I further agree that this Waiver shall apply to all visits within the next twelve (12) months by me and by any minor Participant in full. By completing this document, I acknowledge that if anyone is hurt or property damaged during my participation in this activity, I may be found by a court of law to have waived my or the minor participant’s right to maintain a lawsuit against Bungee Fitness Ltd or any RELEASED PARTIES on the 11 Timothys Bridge Road, Stratford Upon Avon, CV37 9NQ E: fly@bungeefitness.club W: www.bungeefitness.club T: 01789 608046 basis of any claim from which I have released them herein. I have had sufficient opportunity to read this entire document.

I have read and understood it, and I agree to be bound by its terms. We cannot list all of the things that could hurt you when using a bungee, but following the rules will help to prevent them from happening. Please contact your local GP prior to bungee fitness club if you are pregnant or have a medical condition/pre‐existing injury that may prevent you from attending
